Scope of Services

Visa Club Consultants provides immigration advisory, strategic visa preparation, legal representation before courts and tribunals, and related services as described on this website and as agreed in engagement letters with individual clients. Services are provided by Diplomatic Club members who are former embassy officers, licensed immigration consultants, or attorneys authorized to practice in their respective jurisdictions.

We do not provide legal advice or representation outside immigration and visa law. We do not provide services in criminal law, civil litigation unrelated to immigration, tax law, or other legal areas outside our expertise. Clients requiring legal advice in areas outside immigration law are advised to engage appropriate counsel.

No Guarantee of Outcomes

Visa Club Consultants does not guarantee visa approvals, case outcomes, or specific results from immigration applications or legal proceedings. Immigration decisions are made by consular officers, immigration adjudicators, and judges who exercise discretion under law. While we prepare cases according to embassy standards and provide legal representation with full professional competence, outcomes depend on factors including the specific facts of your case, the discretion of decision-makers, changes in immigration law or policy, and information that may not be available to us during case preparation.

No statements made during consultations or in written communications constitute guarantees of outcome. Any estimates of likelihood of success are professional opinions based on experience and should not be interpreted as promises or warranties.

Client Responsibilities

Clients are responsible for providing complete and accurate information required for case preparation. This includes disclosing prior immigration violations, criminal history, prior visa refusals, and any other information that may affect immigration eligibility or admissibility. Failure to disclose material information may result in visa refusals, inadmissibility findings, or immigration fraud determinations that Visa Club Consultants cannot remedy.

Clients are responsible for following strategic advice provided by Diplomatic Club members, attending scheduled consultations, responding to requests for additional documentation within specified timeframes, and complying with immigration laws and regulations of the countries involved in their cases. We reserve the right to withdraw from representation if clients fail to provide required information, disregard strategic advice, or engage in conduct that we determine to be fraudulent or contrary to professional ethics.

Fees and Payment Terms

Fee structures vary based on the complexity of your case, whether legal representation is required, and which Diplomatic Club member is handling your matter. Fees are established through engagement letters that specify the scope of services, payment schedules, and any additional costs such as government filing fees, translation costs, or courier charges.

Payment terms are specified in engagement letters. For legal representation matters, retainer payments are typically required before work commences. For advisory services, payment structures may include initial consultation fees, case preparation fees, and ongoing advisory fees depending on the nature of engagement. Fees are non-refundable once work has commenced except as specified in engagement letters or required by professional responsibility rules governing legal practice.

Clients are responsible for government fees, translation costs, document procurement expenses, courier charges, and other third-party costs incurred during case preparation. These costs are billed separately and are not included in professional fees unless specifically stated in engagement letters.

Confidentiality and Privilege

Communications between clients and Visa Club Consultants are confidential. For cases involving legal representation by licensed attorneys or immigration consultants, solicitor-client privilege applies and communications are protected from disclosure except as required by law or court order. For advisory services not involving formal legal representation, confidentiality is maintained through non-disclosure protocols that prevent sharing of client information with third parties unless authorized by the client or required by legal obligation.

Clients should be aware that solicitor-client privilege does not protect communications that involve planning or commission of fraud or other illegal activity. If we determine that a client is engaging in immigration fraud or providing false information to immigration authorities, we are required to withdraw from representation and may be obligated to report such conduct to relevant authorities depending on jurisdictional requirements.

Termination of Services

Either party may terminate engagement upon written notice subject to the terms specified in engagement letters and professional responsibility rules governing legal practice. Visa Club Consultants reserves the right to withdraw from representation if clients fail to provide required information, disregard strategic advice, engage in fraudulent conduct, fail to make required fee payments, or if conflicts of interest arise that prevent continued representation.

Upon termination, clients remain responsible for fees earned through the date of termination and for any costs incurred on their behalf. We will provide copies of case files and documentation as required by professional responsibility rules and as specified in engagement letters. For legal representation matters involving court deadlines or tribunal hearings, termination procedures must comply with court rules and may require court approval before withdrawal is effective.

Limitation of Liability

To the extent permitted by law and professional responsibility rules, Visa Club Consultants' liability for professional services is limited to the fees paid for those services. We are not liable for consequential damages, lost opportunities, or indirect losses resulting from visa refusals, immigration delays, or adverse case outcomes.

This limitation of liability does not apply to liability arising from professional negligence, breach of fiduciary duty, or violations of professional responsibility rules where such limitation would be unenforceable under applicable law. For legal representation matters, liability is governed by professional indemnity insurance and professional responsibility frameworks applicable in the jurisdiction where representation occurs.

Governing Law and Dispute Resolution

Disputes arising from services provided by Visa Club Consultants are governed by the law of the jurisdiction where the Diplomatic Club member providing services is licensed to practice. For services provided by Canadian immigration consultants or lawyers, disputes are governed by Canadian law and professional responsibility frameworks. For services provided by counsel practicing in Pakistan, disputes are governed by Pakistani law and bar association rules. For services provided in European jurisdictions, disputes are governed by the law of the country where the providing counsel is licensed.

Disputes should first be addressed through good faith negotiation. If resolution cannot be achieved through negotiation, disputes may be resolved through arbitration or mediation as specified in engagement letters or as required by professional responsibility rules. Legal disputes involving professional negligence or breach of fiduciary duty are subject to the jurisdiction of courts and professional disciplinary bodies in the jurisdiction where services were provided.

No Attorney-Client Relationship Without Engagement

No attorney-client relationship or formal advisory relationship is created between you and Visa Club Consultants by visiting this website, sending email inquiries, or participating in preliminary case assessment. Attorney-client relationships and formal engagement are established only through execution of engagement letters specifying the scope of services, fees, and terms of representation.

Information provided during preliminary case assessment is confidential but does not create legal obligations on either party. Preliminary assessments are provided to determine whether Visa Club Consultants can assist with your matter and whether formal engagement is appropriate.

Information provided here may not reflect the most current legal developments and should not be relied upon as a substitute for professional legal advice specific to your circumstances.

This website does not create an attorney-client relationship. Professional Responsibility and Ethical Obligations

Diplomatic Club members providing services through Visa Club Consultants are bound by professional responsibility rules governing legal practice in their respective jurisdictions. This includes obligations to maintain client confidentiality, avoid conflicts of interest, provide competent representation, and comply with rules governing attorney conduct and immigration consultant standards.

Where conflicts exist between these terms of service and professional responsibility rules governing licensed counsel, professional responsibility rules take precedence. Clients receiving legal representation have rights under professional responsibility frameworks including the right to file complaints with law societies, bar associations, or regulatory bodies governing immigration consultants if they believe professional standards have been violated.

Changes to Terms of Service

Visa Club Consultants reserves the right to modify these terms of service to reflect changes in legal requirements, professional responsibility standards, or operational practices. Material changes will be communicated to active clients through direct correspondence. Continued engagement after notification of changes constitutes acceptance of modified terms. Where changes affect existing engagement letters, modifications will be implemented in accordance with terms specified in those agreements.
